The Orange Democratic Movement (ODM) has voiced strong concerns over delays in forming the Independent Electoral and Boundaries Commission (IEBC) selection panel, describing the stalemate as a threat to Kenya’s democratic process.
During a Central Committee meeting chaired by Kisumu Governor Anyang’ Nyong’o, ODM highlighted how the delay has affected pending by-elections in Ugunja and Magarini and the clearance of a nominated Member of Parliament, leaving 11 electoral areas without representation.
“ODM as a party is one of the most affected by this continued state of affairs. We are down three members in the National Assembly alone, with pending by-elections in Ugunja, Magarini, and one nominated member, all of which were held by ODM,” the party stated.
The selection panel is tasked with recruiting seven IEBC commissioners, essential for overseeing elections. Delays in appointing these commissioners hinder preparations for the 2027 General Election and slow the conduct of by-elections mandated by the Constitution, which requires elections within 90 days of a vacancy.
ODM has appealed to the Judiciary to expedite petitions blocking by-elections, emphasizing that these elections are a matter of national urgency. The party warned that the new commissioners will need adequate time to settle in and manage election preparations.
Notable vacancies include former Ugunja MP Opiyo Wandayi and former nominated MP John Mbadi, both appointed to cabinet positions by President William Ruto. Other vacancies arise from the deaths of several Members of County Assemblies (MCAs).
ODM’s statement underscores the urgent need to finalize the IEBC panel to maintain Kenya’s electoral timeline and uphold democratic representation.
